New Regulation & The purchase mechanism of energy-saving products and environmental label products has been greatly adjusted, which will be implemented on April 1.

Recently, the Ministry of Finance jointly issued the Notice on Adjusting and Optimizing the Implementation Mechanism of Government Procurement of Energy-saving Products and Environmental Marking Products, jointly with the Development and Reform Commission, the Ministry of Ecological Environment and the General Administration of Market Supervision. The circular requires that the list of energy-saving products and environmental label products procured by the government be managed, and that the list of government procurement of energy-saving products and environmental label products be no longer issued. Gradually expand the scope of certification bodies for energy-saving products and environmental label products.

Concerning the central budget units, the departments of finance (bureaus) of provinces, autonomous regions, municipalities directly under the Central Government and cities with separate plans, the development and reform commissions (ECC, ICT, ICT, ECB), the environmental protection department (bureau), the market supervision departments, the finance bureau, the development and reform commission, ICT, the Environmental Protection Bureau and the market supervision bureau of the Xinjiang Production and Construction Corps:

In order to fulfill the requirements of the reform of release control clothing, improve the government's green procurement policy, simplify the implementation mechanism of government procurement of energy-saving (water-saving) products and environmental label products, and optimize the market environment for suppliers to participate in government procurement activities, the following notifications are given on matters related to government procurement of energy-saving products and environmental label products:

Implementing inventory management of energy-saving products and environmental label products purchased by the government. Departments such as the Ministry of Finance, the Development and Reform Commission and the Ministry of Ecology and Environment determine the categories of products that are prioritized and mandatory purchased by the government and the relevant standards and norms based on such factors as energy-saving and environmental protection performance of products, technological level and market maturity, and publish and adjust them in the form of catalogues. No more government procurement lists of energy-saving products and environmental label products will be issued.

Implementing government priority procurement and compulsory procurement according to the list of items and certification certificates. Where the products purchased by the purchaser belong to the scope of the list of items, the purchaser and the procurement agency entrusted by the purchaser shall, on the basis of the certification certificate of energy-saving products and environmental label products issued by the certification authority designated by the State and within the period of validity, give priority to government procurement or compulsory procurement of the certified products.

Gradually expand the scope of certification bodies for energy-saving products and environmental labels. According to the development of certification bodies, the General Administration of Market Supervision and the relevant departments will gradually increase the number of certification bodies for energy-saving products and environmental labels in accordance with the principles of pilot first, gradual opening up and orderly competition. Strengthen the supervision of relevant certification market, implement double random and open supervision, establish credit supervision mechanism of certification institutions, and crack down on illegal certification activities.


4.

Publish information on certification bodies and certified products. The General Administration of Market Supervision organizes the establishment of an information release platform for certification results of energy-saving products and environmental labeling products, and publishes information on relevant certification bodies and certified products. The certification bodies of energy-saving products and environmental label products should establish and improve the data sharing mechanism, and provide relevant information to the information publishing platform of certification results in a timely manner. The Chinese Government Procurement Network (www.ccgp.gov.cn) establishes a link with the platform for issuing information on certification results, which facilitates procurement agents and purchasing agents to inquire about certification bodies and certified products.


5.

Increase the government's green procurement efforts. For the categories of products listed in the catalogue, the purchaser can put forward higher requirements of saving resources and protecting the environment in the purchasing demand, and give priority to qualified certified products. For products not included in the catalogue, purchasers are encouraged to take into account such factors as energy saving, water saving, environmental protection, recycling, low carbon, regeneration and organic factors, refer to relevant national standards, industry standards or group standards, and put forward relevant green procurement requirements in the procurement requirements, so as to promote the popularization and application of green products.

This Circular shall be implemented as of April 1, 2019. Notice of the Ministry of Finance on the Adjustment and Publication of the Government Procurement List of Environmental Marking Products Phase 22 (Finance Treasury No. 70, 2018) and Notice of the State Development and Reform Commission of the Ministry of Finance on the Adjustment and Publication of the Government Procurement List of Energy-saving Products Phase 24 (Finance Treasury No. 2018 73) were also discontinued.
